Waste Collection Brent Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Brent provides waste collection, removal and related services to residential and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before using our waste collection services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Customer means the person, company or organisation requesting and paying for the services.

1.2 Services means any waste collection, removal, loading, transportation, disposal, recycling, clearance or related services carried out by Waste Collection Brent.

1.3 Waste means any refuse, rubbish, junk, household waste, commercial waste, garden waste, bulky items or other materials presented for collection under the Services, excluding hazardous and prohibited materials as set out in these Terms and Conditions.

1.4 Agreement means the contract between Waste Collection Brent and the Customer comprising these Terms and Conditions and the confirmed booking details.

2. Scope of Services

2.1 Waste Collection Brent provides scheduled and ad hoc waste collection and removal services within its operational service area. The precise nature of the Services, including location, type of waste, quantity, date and time, will be agreed as part of the booking process.

2.2 The Services may include manual loading of waste into our vehicle, transportation to an authorised facility and disposal or recycling in accordance with applicable laws and regulations.

2.3 We reserve the right to refuse to collect any items that are not accurately described at the time of booking, that are unsafe to handle, or that fall outside the agreed scope or legal restrictions.

3. Booking Process

3.1 Bookings can be requested by telephone, email or online form where available. A booking is only confirmed when we issue a written or electronic confirmation specifying the agreed date, approximate time window, service description and price estimate or quote.

3.2 The Customer is responsible for providing accurate and complete information when arranging a waste collection, including:

a. The full address and access details for the collection point.

b. The type and approximate volume or weight of waste to be collected.

c. Any special access requirements, such as parking restrictions, loading limitations or building entry procedures.

3.3 Where the Customer requests a specific collection time, we will use reasonable endeavours to meet that request. However, all times are estimates and may be subject to change due to traffic, vehicle availability, operational constraints and safety considerations.

3.4 We may request photographs or additional information about the waste to provide an accurate estimate and to ensure compliance with waste regulations.

4. Access and Customer Obligations

4.1 The Customer must ensure that our staff and vehicles have safe, legal and unobstructed access to the collection point at the agreed time.

4.2 The Customer warrants that either:

a. They are the owner of the waste and have full authority to request its removal, or

b. They have obtained the full permission of the owner or responsible party to dispose of the waste.

4.3 The Customer must clearly separate waste types where requested, for example, separating general waste from recyclable or green waste, and must not mix prohibited materials with general waste.

4.4 If access is obstructed, unsafe or illegal (for example due to parking restrictions), we may at our discretion:

a. Attempt to carry out the collection if reasonably possible and safe, or

b. Refuse or postpone the collection and charge a reasonable aborted visit or waiting time fee.

5. Pricing and Payment Terms

5.1 Unless otherwise agreed in writing, prices are based on the type and volume of waste, labour required, distance travelled, disposal costs and any additional services requested.

5.2 Any prices provided before the collection are estimates based on the information given by the Customer. If, on arrival, the volume, weight or nature of waste is different from that described, we may revise the price accordingly. Work will only proceed with the Customer's agreement to the revised price.

5.3 All prices are exclusive of any applicable value added tax or similar taxes, which will be added at the prevailing rate if applicable.

5.4 Payment is due in full on or before completion of the collection, unless a prior written credit arrangement has been agreed. We may accept payment by cash, card, bank transfer or other approved methods.

5.5 For account or commercial Customers with agreed credit terms, invoices are payable within the period stated on the invoice. We reserve the right to charge interest and late payment fees in accordance with applicable legislation for any overdue sums.

6. Cancellations and Changes

6.1 The Customer may cancel or amend a booking by giving notice by telephone or email.

6.2 If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.

6.3 If the Customer cancels within 24 hours of the scheduled collection time, we reserve the right to charge a reasonable cancellation fee to cover administration, scheduling and any wasted travel or staffing costs.

6.4 If we attend the site and are unable to complete the collection due to reasons within the Customer's control, including lack of access, incorrect information, or absence of an authorised person where required, we may charge an aborted visit fee and any associated costs.

6.5 Waste Collection Brent may cancel or reschedule a booking at any time due to operational reasons, safety concerns, vehicle breakdown, adverse weather or circumstances beyond our reasonable control. In such cases, we will notify the Customer as soon as practicable and offer an alternative date or a refund of any pre-paid amounts for services not provided.

7. Waste Types and Regulations

7.1 Waste Collection Brent operates in compliance with all relevant waste management, environmental and transport laws and regulations. We only dispose of waste at authorised facilities.

7.2 The Customer acknowledges that certain materials are hazardous, controlled or prohibited and cannot be collected as general waste. Prohibited items include, but are not limited to:

a. Asbestos or asbestos-containing materials.

b. Clinical or medical waste, syringes and pharmaceuticals.

c. Flammable, explosive or corrosive substances, including petrol, oil, gas cylinders and certain chemicals.

d. Paint, solvents, pesticides and other hazardous liquids, unless specifically agreed in writing.

e. Large quantities of electrical equipment or batteries requiring specialist treatment.

7.3 If prohibited or hazardous items are discovered during loading, we may refuse to collect them and may remove only the non-hazardous waste. Additional charges may apply for any extra handling or segregation required.

7.4 The Customer is responsible for accurately identifying and declaring any hazardous or special waste prior to booking. Failure to do so may result in additional charges, refusal of service and potential reporting to the relevant authorities.

7.5 We will use reasonable efforts to recycle or recover waste where commercially and practically feasible, subject to local infrastructure and regulatory requirements.

8. Service Performance and Time Windows

8.1 All collection times and time windows are estimates. While we strive to be punctual, delays can occur for reasons outside our control.

8.2 The Customer must ensure that waste is ready for collection at the start of the agreed time window, and that an authorised person is available if required to grant access or confirm work.

8.3 We will not be liable for any loss or inconvenience caused by a delay or rescheduling of the collection, provided that we act with reasonable care and keep the Customer informed where practicable.

9. Customer Responsibilities and Warranties

9.1 The Customer is responsible for ensuring that all waste presented for collection is safely accessible and does not pose a risk to our staff, vehicles or the public.

9.2 The Customer warrants that the waste does not contain any hidden hazardous items, sharp objects or other dangers that they have not disclosed.

9.3 The Customer shall indemnify Waste Collection Brent against all claims, losses, damages, costs and expenses arising out of or in connection with any breach of these warranties or any failure by the Customer to comply with applicable laws and regulations.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

10.2 Subject to clause 10.1, our total liability to the Customer for any loss or damage arising out of or in connection with the Services or this Agreement, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable by the Customer for the specific collection giving rise to the claim.

10.3 We shall not be liable for any:

a. Loss of profits, revenue, business or goodwill.

b. Indirect or consequential loss or damage.

c. Loss arising from events beyond our reasonable control, including traffic delays, severe weather, accidents, strikes, or actions of third parties.

10.4 The Customer is responsible for protecting any surfaces, fixtures and fittings on their property that may be affected by the removal of waste. We will take reasonable care when carrying out the Services, but shall not be liable for cosmetic damage to flooring, walls, door frames or other areas, unless caused by our negligence.

11. Insurance

11.1 Waste Collection Brent maintains insurance cover appropriate to the nature of its operations, including public liability insurance to a reasonable level.

11.2 Details of our insurance cover are available on request. The Customer remains responsible for ensuring that their own insurance arrangements are adequate for their needs.

12. Data Protection and Privacy

12.1 We collect and process personal data necessary to manage bookings, provide the Services, issue invoices and comply with legal obligations.

12.2 Customer details are handled in accordance with applicable data protection legislation. We will not sell or rent personal data to third parties and will only share information where required to deliver the Services, process payments, or meet legal or regulatory requirements.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of our waste collection services, you should contact us as soon as possible, providing full details of the issue.

13.2 We will investigate complaints promptly and aim to resolve them fairly and amicably. Where appropriate, we may offer to re-attend or provide a partial refund for services not delivered as agreed.

13.3 If a dispute cannot be resolved between us within a reasonable period, either party may pursue their rights through the courts as set out in clause 15.

14. Changes to these Terms and Conditions

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business practices or the Services we offer.

14.2 The version in force at the time of your booking will apply to that particular Agreement. We recommend that you review the Terms and Conditions periodically when using our waste collection services.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed from the remaining provisions, which shall continue in full force and effect.

16.2 No failure or delay by Waste Collection Brent in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 The Customer may not assign or transfer any of their rights or obligations under this Agreement without our prior written consent. We may assign or subcontract our rights and obligations where necessary for the proper performance of the Services.

16.4 These Terms and Conditions, together with the booking confirmation and any agreed variations in writing, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or representations.
